Terms and Conditions of the online store Lejaan.pl
I. PRELIMINARY PROVISIONS
This Lejaan.pl Online Store Regulations (hereinafter referred to as "the Regulations") governs the rights and obligations of the parties to the agreement during the conclusion and execution of a sale and purchase agreement (hereinafter referred to as "the Agreement") between the Seller on the one hand and the Client, as the Buyer, on the other hand, the subject of which is the sale of Goods and their delivery to the Client. For the purposes of these Regulations, it is assumed that the Seller means the company:

The Client is obliged to familiarise themselves with these Regulations before using the Services.

The subject of the Agreement is – in accordance with these Regulations – the Seller's obligation to deliver the Goods to the Client, to enable them to acquire ownership thereof, and the Client's obligation to accept the Goods and pay the Price to the Seller, as well as the Shipping Fee or Cash on Delivery Fee and Packaging Price.

For the purposes of these Regulations, the following capitalized terms shall have the meanings set out below:

Client is a person using the Service and for the purposes of these Regulations may also be referred to as the Buyer. The Client may be a Consumer within the meaning of the provisions of the Polish Civil Code, an Entrepreneur with consumer rights, or an Entrepreneur;

User Account Owner is a person who has created a User Account on the website www.lejaan.pl;

User Account is the user interface available via the website www.lejaan.pl;

Order means a binding proposal for concluding the Agreement directed by the Buyer to the Seller;

Price is the amount which – in accordance with the Agreement – the Client undertakes to pay the Seller for the Goods and which was specified in the Order; in case of discrepancies between the price given for a given type of Goods and the price given in the Order summary, the price given in the Order summary is binding;

Goods are items whose specifications and properties are given on the Website, which are offered for sale on that Website and which have been included by the Client in the Order by placing these items in the virtual shopping cart (gift vouchers activated by entering the gift voucher code in the User Account in the "My Coupons" section are also considered Goods);

Shipping Fee means the amount charged to the Client in addition to the Price, if the Price is less than 524 PLN, for which the Seller undertakes to ensure the transport of the Goods to the place indicated by the Client in Poland and, in case of non-acceptance of the Goods by the Client, the transport of the Goods from the place where the Goods were to be delivered back to the Seller;

Service means the interface on the website www.lejaan.pl, through which Orders are placed and the Agreement is concluded;

Website means the website www.lejaan.pl;

Coupon means a virtual unit enabling the Client to pay the Price via the User Account. One Coupon corresponds to 1 PLN. Coupons are not exchangeable for cash.

Cash on Delivery Fee means the price for the service of collecting the Price from the Client by the carrier upon receipt of the Goods by the Client.

Packaging Price is the cost of specially ordered packaging for the Goods, usually for a gift.

The Agreement is concluded between the Seller and the Client via the Service. The Agreement is concluded at the moment the Seller sends the Client confirmation of receipt of the Order. The Seller, along with the confirmation of receipt of the Order, provides the Client with these Regulations by e-mail on a durable medium, as well as general guidelines for the care of textile goods.

Upon conclusion of the Agreement, the Seller is obliged to deliver the Goods to the Client and transfer ownership thereof, and the Client is obliged to pay the Price for the Goods and the Shipping Fee.

All relations between the Seller and the Client are subject to Polish law, in particular the Act of 23 April 1964 – Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended) and the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended). The choice of Czech law in agreements with consumers residing in Poland does not deprive them of the protection granted to them under unconditionally binding provisions of Polish law.
II. INFORMATION FOR CONSUMERS BEFORE CONCLUDING THE AGREEMENT
The Seller informs the Client that:

The costs of remote communication do not deviate from the standard rates of the Client's operator.

Requires payment of the Price, Shipping Fee, Cash on Delivery Fee and possibly Packaging Fee before accepting the Goods, and in the case of bank transfer selection - before sending the Goods to the Client;

The prices of Goods on the Website include VAT and all fees provided for by law. Delivery cost varies depending on the chosen method;

The Client who is a consumer has the right to withdraw from the agreement within 14 days, starting from the day the consumer or a third party indicated by them other than the carrier takes possession of the Goods. Information about withdrawal should be sent to the e-mail address: customerservice@lejaan.pl or by using the return form in the User Account.

The right to withdraw from the agreement does not apply to agreements where the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individualized needs (e.g., personalized products).

In case of withdrawal from the agreement, the Consumer bears the direct costs of returning the Goods, unless they use the free return service provided by the Seller.

The Consumer has the right to use out-of-court methods for handling complaints and pursuing claims (e.g., ODR platform, Consumer Ombudsmen, Trade Inspection in Poland).

The Client consents to the use of means of distance communication when concluding the Agreement.
III. ORDER

Orders can only be delivered via the Service.

In the Shopping Cart, the Client can edit the Order until clicking the button with the obligation to pay.

Available payment methods are: payment cards (3D Secure), przelewy24, blik, PayPal, cash on delivery, and bank transfer in advance.

Order confirmation is made by clicking the "Order with obligation to pay" (or equivalent) button. After clicking it, the Order becomes binding.
IV. PRICE

The Price of the Goods includes VAT.

In accordance with the Omnibus directive, in the event of a price reduction (promotion), the Seller informs, next to the reduced price, about the lowest price of this Goods in the 30-day period before the reduction was introduced.

The terms of the loyalty program (10% discount on the next purchase within 18 months) remain in force in accordance with the terms stated on the website.
V. CONCLUSION OF THE SALE AND PURCHASE AGREEMENT

The agreement is concluded upon the Seller's confirmation of acceptance of the Order (email message).

The Buyer acquires ownership of the Goods upon receipt of the delivered Goods and payment of the full Price.
VI. FULFILLMENT DEADLINE

The Seller undertakes to dispatch the goods as soon as possible. The standard delivery time is specified in the purchasing process. The Seller undertakes to deliver the Goods immediately, no later than 30 days from the conclusion of the Agreement.
VII. OTHER RIGHTS AND OBLIGATIONS

The LEJAAN swatch is considered Goods. After purchasing the swatch, the Client receives a voucher reducing the value of their next order. The right to withdraw from the purchase of the swatch within 14 days remains in force.
VIII. USER ACCOUNT and IX. PERSONAL DATA (GDPR)
Technical provisions remain unchanged - compliant with general GDPR requirements applicable throughout the EU.
X. NON-CONFORMITY OF GOODS WITH THE AGREEMENT AND COMPLAINTS

The Seller is obliged to deliver Goods in conformity with the Agreement. The provisions of this article define the rights of the Consumer (and entrepreneurs with consumer rights) in case of non-conformity of the goods with the agreement, resulting from the consumer rights act. For Clients who are entrepreneurs (not with consumer rights), the warranty for defects is excluded.

Goods are in conformity with the agreement if their: description, type, quantity, quality, completeness, and functionality, in particular, conform to it.

If the Goods are not in conformity with the agreement, the Consumer may demand their repair or replacement.

The Seller may make a replacement when the Consumer demands repair, or a repair when the Consumer demands replacement, if bringing the Goods into conformity with the agreement in the manner chosen by the Consumer is impossible or would entail excessive costs for the Seller.

The Seller performs repair or replacement within a reasonable time from the moment they were informed of the non-conformity, and without undue inconvenience for the Consumer. The costs of repair or replacement are borne by the Seller. The Consumer provides the Goods to the Seller for repair or replacement.

If the Goods are not in conformity with the agreement, the Consumer may submit a statement of price reduction or withdrawal from the agreement, in situations where:

The Seller refused to bring the Goods into conformity with the agreement;

The Seller did not bring the Goods into conformity with the agreement;
-
The non-conformity of the Goods with the agreement still exists, despite the Seller's attempts to bring the Goods into conformity with the agreement;
-
The non-conformity is significant enough to justify a price reduction or withdrawal from the agreement without prior exercise of the right to repair or replacement.

The Consumer cannot withdraw from the agreement if the non-conformity of the Goods with the agreement is insignificant.

The Seller is liable for the non-conformity of the Goods with the agreement existing at the time of their delivery and revealed within 2 years from that moment. It is presumed that non-conformity revealed before the expiry of 2 years from the delivery of the Goods existed at the time of their delivery.

Complaint notifications can be submitted electronically to: customerservice@lejaan.pl or by using the form.

The Seller will respond to the Consumer's complaint within 14 days from the date of its receipt. Failure to respond within this period means that the Seller considered the complaint justified.
XI. WITHDRAWAL FROM THE AGREEMENT

The Consumer has the right to withdraw from the Agreement without giving a reason within 14 days from the date of taking possession of the Goods.

To exercise the right of withdrawal, the Consumer may fill out an online form on Lejaan.pl or submit an unambiguous statement sent electronically.

In case of withdrawal from the Agreement, the Seller will refund to the Consumer all payments received, including delivery costs (except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest regular delivery method), immediately, and in any case no later than 14 days from the day of receiving the withdrawal statement.

The Consumer is liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
XII. FINAL PROVISIONS

The Agreement can be concluded in Polish.

Out-of-court dispute resolution: In case of exhausting the complaint procedure, the Consumer has the right to use out-of-court methods of complaint resolution. A Consumer in Poland may apply to the Provincial Inspector of the Trade Inspection for the initiation of mediation proceedings, or to a permanent amicable consumer court.
Information on out-of-court dispute resolution methods can be found on the website of the Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl.
Customers can also use the EU online dispute resolution (ODR) platform available at: http://ec.europa.eu/consumers/odr/.
If any provision of the Regulations is or becomes invalid or ineffective, it shall be replaced by a legally valid provision that best reflects the economic purpose of the original provision.
